Terms of Use
These Terms govern your use of the Jotmatic app (the "App"), operated by Nexios Media LLC, an Illinois limited liability company ("we", "us"). By using the App you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 13 years old. If you are under the age of majority where you live, use the App only with a parent's or guardian's consent.
2. Recording consent
The App records audio you choose to record. You alone are responsible for complying with recording and privacy laws, including getting everyone's permission before you record them where the law requires it. Don't use the App to record anyone secretly.
3. Subscriptions and purchases
- Recording, transcripts, search and export are free. Automatic notes are free for your first three recordings; after that they, and some other features, need Jotmatic Pro: a yearly subscription (with a free trial for eligible new subscribers), a monthly subscription, or a one-time lifetime purchase. Prices are shown in the App before you buy.
- Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
- Subscriptions renew automatically at the same price and duration unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in Settings › Apple Account › Subscriptions on your iPhone. Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com).
4. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for personal use, as permitted by the App Store's Usage Rules. You may not copy, modify, reverse engineer, resell or redistribute the App except as the law allows.
5. Your content
Your recordings, transcripts, notes and flashcards belong to you and stay on your device. We claim no rights to them and have no copy of them. Please keep your own backups; we can't recover lost data.
6. On-device AI and accuracy
Transcripts, summaries, action items, translations, word lists and other notes are generated automatically by on-device models and may be incomplete or wrong. Check anything important before relying on it. Features depend on your device, iOS version and language: notes need an iPhone with Apple Intelligence turned on.
7. Acceptable use
Don't use the App to break the law, infringe others' rights, or interfere with the App's security.
8. Apple
These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and, to the maximum extent the law allows, no warranty obligation. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Standard EULA applies where these Terms don't cover something.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT RECORDINGS WILL NEVER BE LOST OR THAT OUTPUTS WILL BE ACCURATE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY WON'T EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR US $10. Some jurisdictions don't allow these limits, so they may not apply to you.
11. Termination
You can stop using the App at any time. We may end your licence if you seriously breach these Terms.
12. Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules, except where the law of your country of residence gives you mandatory consumer protections.
